Easements filed for 39-66 44th Street's block keep some garden walks open forever

The Declaration of Easements and Restrictions for Block 182, the Madison Court block that holds 39-66 44th Street, is dated May 2, 1927. Most Sunnyside easements were written to run forty years, generally until 1966, because the lending banks insisted, but a few were permanent, such as rights for utilities and rules that kept setbacks for light and air. At Madison Court, the walks through some of the shared gardens were also protected permanently.

“At Madison Court, the sidewalks through some of the common gardens were also covered by the perpetual easements.”

39-66 44th Street rises in a Madison Court North row of eight facing a central garden

Built in 1927, this two-story house with an attic belongs to a row of eight on the west side of 44th Street that runs perpendicular to the street grid and faces a hedged central lawn. It is a type B house, alternating with its mirror-image neighbors. The doorways have white elliptical fan panels set under arched brick lintels with paired soldier-brick keystones, and chimneys rise after every second house along the slate roof.

When the commission surveyed 39-66 44th Street, block 182, lot 97, in 2007, its raised rear yard held flower beds and bluestone pavers set in concrete behind a chain-link fence and gate. The painted basement had two jalousie windows and a newer door with a pipe rail. In front, a wood and glass door with an aluminum storm door opened onto a brick stoop with a bluestone landing, with a light fixture and mailbox beside it.
