Deed covenants for the Madison Court block bind this house and its neighbors to shared rules

The City Housing Corporation's declaration of easements for tax block 182, the Madison Court block that includes 39-55 43rd Street, is dated May 2, 1927. Sunnyside buyers signed such covenants when they bought their lots: they banned garages, fences, hedges, clothes lines and signs, and required the court trustees' written consent before an owner altered a porch or repainted in a new color. Most of the terms were set to run for forty years, but the walks crossing some of Madison Court's gardens were placed under permanent easements.

“Block 182 (dated May 2, 1927)... At Madison Court, the sidewalks through some of the common gardens were also covered by the perpetual easements.”

Built in 1927, 39-55 is the fifth house in a row of ten in Madison Court South and one of the six flat-roofed houses at the center of the row, with a parapet and cast-stone coping. The Landmarks Preservation Commission's 2007 designation report found three casement windows in a narrowed opening where the first floor's paired windows had been, and a fully paved front yard. At the back, the porch had been enlarged to two bays, with formstone siding on its first floor, and there was a large wood deck.

“3 casement windows replace paired windows in reduced opening at first floor... enlarged (2 bay) porch... large wood deck…”
